This website, www.melodows.com (the Site), is owned and operated by APEXRISE S.R.L., a company registered in Romania with its registered office at Bucuresti Sectorul 3, Strada Nerva Traian, Nr. 27-33, Birou nr. 6, Scara B, Etaj 1. Throughout these Terms, the words we, us, and our refer to APEXRISE S.R.L., trading as Melodows.

By accessing or making a purchase through the Site, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not accept these Terms in full, please discontinue use of the Site immediately.

SECTION 2 - ELIGIBILITY AND ACCOUNT TERMS

To use our Site and place orders, you must be at least 18 years of age, or the age of majority in your jurisdiction. By using the Site, you confirm that you meet this requirement. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion, including where we suspect misuse, fraud, or violation of these Terms.

SECTION 3 - RESTRICTED AREAS

We do not ship to, or provide services for, individuals or entities located in regions subject to comprehensive international sanctions, including but not limited to: Iran, Syria, North Korea, Cuba, Russia, Belarus, Venezuela, Myanmar, Somalia, Yemen, Zimbabwe, and the Crimea, Donetsk, Luhansk, Zaporizhzhia, and Kherson regions of Ukraine. Orders with delivery addresses in these areas will be cancelled and refunded. By placing an order, you confirm that you are not located in, or a resident of, any such restricted region.

SECTION 4 - PRODUCTS AND PRICING

We make every reasonable effort to display product images, colors, and descriptions as accurately as possible. However, we cannot guarantee that your device screen will render colors with complete accuracy. Product availability and pricing are subject to change without prior notice. We reserve the right to limit quantities, discontinue products, or correct pricing errors at any time.

All prices are displayed in the currency shown at checkout. Any applicable taxes or duties are the responsibility of the buyer unless otherwise stated.

SECTION 5 - ORDERS AND PAYMENT

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. Once an order is confirmed, you will receive an email acknowledgment. We may cancel or limit orders that appear to be placed by resellers, or where payment cannot be verified.

You agree to provide accurate billing, shipping, and payment information. Credit card and payment data is encrypted during transmission and handled in accordance with applicable security standards.

SECTION 6 - RIGHT OF WITHDRAWAL (COOLING-OFF PERIOD)

If you are a consumer located in the European Union or European Economic Area, you have the right to withdraw from your purchase without giving any reason within 14 calendar days from the day you, or a third party designated by you, receive the goods (the cooling-off period).

To exercise your right of withdrawal, you must notify us of your decision by sending a clear written statement to connect@melodows.com before the 14-day period expires. You may use the following model withdrawal statement:

I/We hereby give notice that I/we withdraw from my/our contract of sale of the following goods: [product name and order number], ordered on [date], received on [date]. Name: [your name]. Address: [your address]. Date: [date].

Upon receipt of a valid withdrawal notice, we will refund all payments received from you, including standard delivery costs, within 14 days, using the same payment method you used for the original transaction. We may withhold the refund until we have received the returned goods or proof of return shipment, whichever is earlier.

You must return the goods without undue delay and no later than 14 days after notifying us of your withdrawal. Return shipping costs are your responsibility unless the goods are defective or incorrectly delivered.

The right of withdrawal does not apply to: goods made to your specifications or clearly personalized; sealed goods that have been opened and are not suitable for return on hygiene grounds; or goods that have been used beyond what is necessary to establish their nature and function.

SECTION 7 - COMPLAINTS AND WARRANTIES

We stand behind the quality of our products. If you receive a defective, damaged, or incorrect item, please contact us at connect@melodows.com within 30 days of delivery with your order number and photographic evidence of the issue. We will assess your complaint and offer an appropriate remedy, which may include a replacement, repair, or refund.

Our products come with a statutory warranty against material defects in accordance with applicable consumer protection law. Where a defect is confirmed, we will remedy it at no cost to you. This warranty does not cover damage caused by misuse, normal wear and tear, or failure to follow care instructions.

SECTION 8 - ACCURACY OF INFORMATION

We reserve the right to correct inaccuracies and update content at any time without notice. You should not rely solely on information from this Site when making purchasing decisions.

We reserve the right to suspend or terminate access for any user who violates these conditions.

To the maximum extent permitted by applicable law, APEXRISE S.R.L. and its directors, employees, agents, and service providers shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Site or our products, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from a transaction shall not exceed the amount you paid for the relevant order.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

SECTION 15 - INDEMNIFICATION

You agree to indemnify and hold harmless APEXRISE S.R.L. and its affiliates, officers, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Site, or your violation of any applicable law or third-party rights.

SECTION 16 - SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

SECTION 17 - TERMINATION

These Terms remain in effect until terminated. We may suspend or terminate your access to the Site at any time if you breach these Terms or if we discontinue the Service. Upon termination, any obligations that by their nature should survive (including payment obligations, indemnification, and dispute resolution) will continue to apply.

SECTION 18 - DISPUTE RESOLUTION AND GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles. If you are a consumer in the EU, you also benefit from any mandatory consumer protection provisions of the law of your country of residence.

In the event of a dispute arising from or relating to these Terms or your use of the Site, we encourage you to contact us first at connect@melodows.com so that we can attempt to resolve the matter amicably. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania, unless applicable consumer protection law in your country of residence grants you the right to bring proceedings in your local courts.

EU consumers may also submit complaints to the European Online Dispute Resolution platform at: ec.europa.eu/consumers/odr.

SECTION 19 - CHANGES TO THESE TERMS

We may update these Terms of Service from time to time to reflect changes in our practices, legal requirements, or business operations. When we do, we will revise the date at the top of this page. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
